1. About these Terms

Welcome to AnseEtoile. These Terms of Service (the “Terms”) explain the rules that apply when you visit our website, create an account, place an order, or otherwise use our online store and related services (together, the “Services”).

In these Terms, “AnseEtoile,” “we,” “us,” and “our” refer to:

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services. Products purchased through our store are sold by AnseEtoile, not Shopify.

By using the Services or placing an order, you agree to these Terms. Please read them together with our [Privacy Policy], [Cookie Policy], [Shipping Policy], and [Returns, Refunds and Cancellations Policy]. If you do not agree to these Terms, you should not use the Services.

Nothing in these Terms limits or excludes any rights or remedies that cannot legally be limited or excluded, including your statutory rights as a consumer.

2. Eligibility and accounts

You must be at least 18 years old, or the age of legal majority where you live, to place an order. If you permit a minor to browse the Services using a device or account you control, you remain responsible for that use.

You agree to provide accurate, current, and complete information when creating an account or placing an order. You are responsible for keeping your login details confidential and for activity carried out through your account. Please contact us promptly if you believe that your account has been accessed without permission.

We may suspend or close an account where we reasonably believe it is being used fraudulently, unlawfully, or in material breach of these Terms. Closing an account does not affect an order that has already formed unless we are legally entitled to cancel that order.

3. Products and print-to-order production

Many AnseEtoile products are printed or produced after an order is placed. This helps us avoid unnecessary stock and waste. Production may begin shortly after we accept your order.

We take reasonable care to display and describe our products accurately. However:

  • colours may look slightly different depending on your screen settings and the printing process;

  • the position, scale, or finish of a print may vary slightly within normal production tolerances;

  • measurements are approximate unless stated otherwise; and

  • packaging may vary without affecting the product itself.

These reasonable variations do not affect your rights if a product is faulty, damaged, materially different from its description, or otherwise does not conform to the contract.

We may change or discontinue products before an order is placed. Changes made after you place an order will not materially alter the product you agreed to purchase without your consent.

4. Personalised products and customer instructions

Some products may be made to your individual specifications or personalised using names, dates, wording, photographs, measurements, colours, or other details you provide.

You are responsible for checking all personalisation details carefully before submitting your order, including spelling, punctuation, dates, image quality, sizing, and layout choices. If we provide a proof for approval, production may begin once you approve it. Approval of a proof does not remove your rights if the finished product is defective or does not match the approved proof.

If you upload or provide text, images, artwork, trademarks, or other content (“Customer Content”), you confirm that:

  • you own it or have all permissions needed for us and our production partners to use it to fulfil your order;

  • our use of it for that purpose will not infringe another person’s rights; and

  • it is not unlawful, threatening, hateful, defamatory, obscene, misleading, or otherwise harmful.

You give us and our production partners a limited, non-exclusive licence to copy, adapt, and use Customer Content only as reasonably necessary to review, produce, fulfil, and support your order. We will not use your private Customer Content for unrelated marketing without your permission.

We may reject Customer Content or cancel the affected item where we reasonably believe it is unlawful, infringes another person’s rights, or breaches these Terms. If we cancel before production for a reason unrelated to your breach, we will refund the amount paid for that item.

The legal exception for personalised or custom-made goods applies only where a product is genuinely made to your individual specifications or clearly personalised. A standard product being printed after you order it is not necessarily a personalised product.

5. Placing and accepting orders

When you submit an order, you offer to purchase the products in your basket under these Terms. An automated acknowledgment confirms that we received your order but does not necessarily mean that we have accepted it. A binding contract is formed when we send you an order acceptance or confirmation, unless that communication clearly states that it is only an acknowledgment.

We may decline or cancel an order before acceptance for a legitimate reason, including:

  • the product or required materials are unavailable;

  • we cannot obtain payment authorisation;

  • there is an obvious pricing or product-description error;

  • we cannot deliver to the address or country supplied;

  • we reasonably suspect fraud, resale activity, or misuse; or

  • Customer Content breaches section 4.

If we cancel an order after taking payment, we will refund the amount paid for the cancelled product and any associated delivery charge. We will contact you using the details supplied with your order.

Products are intended for personal or household use unless we agree otherwise in writing. Please contact us before placing a wholesale or resale order.

6. Prices, taxes, and payment

The price shown at checkout is the price payable for your order, subject to correction of an obvious error. Delivery charges are shown separately before you place the order.

For international orders, the recipient may be responsible for customs duties, import taxes, and clearance fees that are not collected at checkout. Where possible, we will make this clear before purchase, but we do not control charges imposed by local authorities.

You confirm that you are authorised to use the payment method submitted. Payment processing may be provided by Shopify or another secure payment provider and may be subject to that provider’s terms and privacy notice.

Promotions and discount codes may have separate conditions, including eligibility and expiry dates. Unless stated otherwise, codes cannot be exchanged for cash or combined. If promotion-specific conditions conflict with these Terms, the promotion-specific conditions apply to that promotion.

7. Order changes and cancellations

Please review your order carefully before submitting it. If you need to change or cancel an order, email anna@anseetoile.com as soon as possible with your order number.

Because production may begin shortly after acceptance, we cannot guarantee that a requested change or cancellation can be made once production has started. This practical limitation does not remove any cancellation right you have under applicable consumer law.

Where UK or European consumer law applies, you may generally cancel an eligible online purchase within 14 days after receiving it without giving a reason. Applicable law may give you additional rights. Statutory change-of-mind cancellation rights generally do not apply to goods genuinely made to your specifications or clearly personalised.

8. Shipping and delivery

Production and delivery timeframes shown on the website are estimates unless we expressly agree to a guaranteed date. We will take reasonable steps to deliver within the stated timeframe and will contact you if we become aware of a significant delay.

We may use third-party printers, fulfilment partners, postal operators, and couriers. Their involvement does not remove any responsibility we have to you under applicable law.

You are responsible for supplying a complete and accurate delivery address. If an order is delayed, returned, or requires redelivery because the address supplied was materially incorrect or incomplete, we may ask you to pay the reasonable additional delivery cost. We will not charge you for an addressing error caused by us.

For consumers, responsibility for the goods passes to you when you, or a person identified by you other than the carrier, takes physical possession of them, except where applicable law provides otherwise or you independently appointed a carrier that we did not offer.

If your order is lost, damaged in transit, or does not arrive within a reasonable period, contact anna@anseetoile.com so we can investigate and provide the remedy required by applicable law.

9. Returns, faulty products, and refunds

Our Returns, Refunds and Cancellations Policy forms part of these Terms. In summary:

  • we offer a 30-day return period for eligible products;

  • customers normally pay return postage for eligible change-of-mind returns;

  • products must be returned unworn, unused, and in their original condition, subject to the handling permitted by law;

  • genuinely personalised or custom-made goods cannot normally be returned merely because you changed your mind;

  • faulty, damaged, incorrect, or misdescribed products may qualify for repair, replacement, price reduction, or refund; and

  • where an item is faulty, damaged, or incorrect, we will cover reasonable return costs when required.

Please inspect your order when it arrives and contact us promptly if there is a problem. We may request your order number, a description, and photographs so we can investigate. A request for photographs does not reduce your statutory rights.

Refunds are normally issued to the original payment method. Any refund will be processed within the period stated in our Returns Policy or the shorter period required by applicable law.

10. Intellectual property

The Services and their content—including our branding, product designs, artwork, photographs, graphics, text, video, audio, and website layout—are owned by or licensed to AnseEtoile and are protected by intellectual-property laws.

We grant you a limited, revocable, non-transferable right to access and use the Services for personal, lawful, non-commercial purposes. Unless we give prior written permission, you must not copy, reproduce, republish, distribute, sell, license, modify, create derivative works from, or commercially exploit our content.

Purchasing a physical product does not transfer copyright, trademark rights, or other intellectual-property rights in the product’s artwork or design.

Shopify’s and other third parties’ names, marks, and content remain the property of their respective owners.

11. Reviews, feedback, and public submissions

If you submit a review, photograph, comment, suggestion, or other material intended to be displayed publicly (“Public Content”), you confirm that it is accurate, lawful, and does not infringe another person’s rights.

You give us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, and display Public Content for operating and promoting AnseEtoile and our products. This licence lasts for as long as needed for those purposes, but you may ask us to stop using Public Content in future marketing where reasonably practicable. This section does not apply to private Customer Content supplied only to personalise an order.

We may moderate or remove Public Content that we reasonably believe is unlawful, misleading, abusive, irrelevant, or infringes another person’s rights. We are not required to publish every submission.

12. Acceptable use

You must not use the Services to:

  • break the law or encourage unlawful activity;

  • infringe intellectual-property, privacy, or other rights;

  • submit malicious code or interfere with the security or operation of the Services;

  • collect another person’s personal information without permission;

  • send spam, impersonate another person, or provide deliberately misleading information;

  • bypass access restrictions or attempt unauthorised access; or

  • scrape, extract, or commercially reuse substantial parts of the Services without permission, except where applicable law does not allow us to restrict that activity.

We may take proportionate steps to protect the Services, including restricting access where we reasonably believe these rules have been breached.

13. Third-party services and links

The Services may contain links to websites or services operated by third parties. We do not control third-party sites and are not responsible for their content, availability, or separate transactions. Please review their terms and privacy practices before using them.

Shopify hosts our store and may process information necessary to provide the ecommerce platform. However, your contract for products purchased from our store is with AnseEtoile. Questions or claims about an AnseEtoile order should be sent to us rather than Shopify.

14. Privacy

Our Privacy Policy explains how we collect, use, share, and protect personal information. Our Cookie Policy explains how cookies and similar technologies are used. Shopify and our payment, production, and delivery partners may process personal information as described in those policies.

15. Availability and events outside our control

We do not promise that the website will always be uninterrupted or error-free. We may temporarily suspend access for maintenance, security, or operational reasons.

We are not responsible for delay or failure caused by an event genuinely outside our reasonable control, such as severe weather, natural disaster, industrial action, widespread carrier disruption, government action, or major network failure. We will take reasonable steps to minimise the effect, keep affected customers informed, and perform our obligations as soon as reasonably possible. This section does not remove any cancellation, refund, or delivery rights you have under applicable law.

16. Our responsibility to you

We do not exclude or limit responsibility where doing so would be unlawful. In particular, nothing in these Terms excludes or limits responsibility for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • breach of rights or remedies that cannot legally be excluded; or

  • goods that are faulty, unsafe, not as described, or otherwise do not conform to the contract where applicable law makes us responsible.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

The Services and products are supplied for private use unless we agree otherwise in writing. If you use them for a business or commercial purpose, we are not responsible for business losses such as lost profits, lost revenue, lost opportunity, lost data, or business interruption, except where such liability cannot legally be excluded.

17. Your responsibility

You are responsible for losses we reasonably incur as a direct result of your unlawful Customer Content, your infringement of another person’s rights, your fraud, or your material breach of these Terms. We will take reasonable steps to reduce avoidable loss and will notify you of a relevant third-party claim where reasonably practicable.

Nothing in this section requires a consumer to compensate us for losses caused by us, losses that are not reasonably foreseeable, or amounts that applicable law does not permit us to recover.

18. Changes to the Services and these Terms

We may update the Services and these Terms from time to time, for example to reflect legal, technical, or business changes. The version published when your order is accepted will normally govern that order.

Material changes will take effect from the date stated in the updated Terms and will not retrospectively reduce rights relating to an existing order. We will provide any notice required by applicable law.

19. Ending access

You may stop using the Services at any time. We may suspend or end access where reasonably necessary because of fraud, unlawful conduct, security risk, or a material breach of these Terms.

Ending access does not affect rights or obligations that arose beforehand. Sections that naturally continue—including intellectual property, responsibility, governing law, and dispute provisions—remain effective.

20. Complaints and disputes

If you have a question or complaint, please contact anna@anseetoile.com. Include your order number, where relevant, and a clear description of the issue. We will try to acknowledge your complaint within 14 business days and resolve it fairly within a reasonable period.

21. General provisions

If a court or competent authority finds part of these Terms unlawful or unenforceable, that part will be treated as removed or limited to the minimum extent necessary. The remaining provisions will continue in effect.

If we delay enforcing a right, that does not waive it. No person other than you and AnseEtoile has a right to enforce these Terms, except where applicable law provides otherwise.

We may transfer our rights and obligations under these Terms as part of a genuine sale, reorganisation, or transfer of our business, provided this does not reduce your rights. You may transfer your rights where the law permits or with our written agreement.

These Terms and the policies expressly incorporated into them form the agreement between you and AnseEtoile concerning the Services and purchases from our store.
